1. Acceptance
By downloading, installing, or using Hermly (the “App”) on an Apple device, you accept these terms and the incorporated Apple Standard End User License Agreement (“Apple EULA”). If you do not accept these terms, do not use the App.
These terms govern your use of Hermly. The short version: we license you the app for personal, non-commercial use; the underlying Apple Standard EULA applies; subscriptions auto-renew through your Apple ID; and Hermly is for informational use only — it does not diagnose, treat, or prevent any condition.

Hermly is distributed through the Apple App Store. Your use of Hermly is governed by Apple's Standard End User License Agreement unless a separate written agreement is signed between you and Hermly. The Apple EULA covers the licence grant, permitted uses, restrictions, services and materials, transfer, consent to use of data, termination, and external services.
Apple is a third-party beneficiary of these terms and is entitled to enforce them against you as a third-party beneficiary of the Apple EULA.
The following addenda apply on top of the Apple EULA and take precedence where they conflict.
Hermly is not a medical device. It is a consumer wellness app providing informational risk assessments and pattern observations from your self-reported and Apple Health data. Hermly does not diagnose, treat, cure, or prevent any condition. Predictions are probabilistic estimates, not clinical diagnoses, and should not replace consultation with a qualified clinician.
Never disregard professional medical advice or delay seeking it because of something the App suggested. In an emergency (sudden severe headache unlike previous attacks, neurological symptoms, etc.), contact your local emergency services or your clinician immediately.
You may stop using Hermly at any time by uninstalling the App. Your in-app data is removed when you delete the App; the encrypted iCloud copy, if any, is governed by Apple's iCloud terms. Hermly may suspend or terminate your access if these terms are materially breached.
The App is provided “as is” and “as available” without warranty of any kind, express or implied, except where prohibited by law. To the maximum extent permitted by law, Hermly and its suppliers will not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of data or profits arising out of or related to your use of the App. The provisions in section 4 of the Apple EULA apply to liability between you and Apple.
We may update these terms from time to time. Material changes will be surfaced in-app on next launch and the “Last updated” date at the top of this page will change. Continued use after such notice constitutes acceptance of the updated terms.

This page is a plain-language draft intended for App Store submission alongside the Apple Standard EULA. The binding obligations remain the Apple EULA plus the addenda in section 3.
